than five days to go before falls right off the fiscal cliff. the senate back in session today and it's the first time the senate or house has met for business between christmas and new year's in more than four decades. president obama cut his hawaii trip short arriving in washington early today. for now, the house of representatives is not in session but we've learned those lawmakers are set to return this weekend. today the senate majority leader, harry reid, says we've just about run out of time. >> if we go over the cliff, and that's where we're headed, mr. president, the house of representatives as we speak with four days left after today before the first of the year, aren't here with the speaker having told them they'll give them 48 hours notice. i can't imagine their consciences, out wherever they are around the country and we're here trying to get something done. >> we're awaiting reaction from the senate minority leader, mitch mcconnell. when that happens we'll go live to the senate floor but a spokesman for john boehner says senator reid should talk less and legislate more.

thought that people would do the right thing with respect to fiscal policy. look, we wouldn't be in this circumstance, you know, president obama actually extended these tax cuts with the intent that washington would take a more reasonable look at how we can phase in fiscal policy in a way that wouldn't do damage to the overall economy. and i think that's something we really have to be concerned about. you said earlier, you know, the average worker making 3,500 -- would see their taxes go up 3,500 should we go over the fiscal cliff. that's a significant impact to individual citizens. and so we should be very concerned about that and what that might mean to the broader economy, which some of us, i think, could put us in a mild recession next year. >> what is it with washington? what is it with our elected leaders they can't come up with a deal at this point? they have to wait to make it a cliff hanger. we saw this with the debt ceiling debacle last summer and now again. do they think this is a popular move? a good move? what's wrong with them? >> alison, you know, look, the re

night, if you listened to president obama. >> i think they have to sound optimistic. the last thing they want to do is not sound optimistic. here's the problem. we've come right to the 11th hour. the fact there's going to be a substantive deal that comes out in the 11th hour is probably nailed to zero. in my sense, it's easier to go over the cliff. then there's clarity, right? taxes up, spending cut. the market will know what is going to happen. it can only get better from there, because then you'll guess legislators that come to the table, that try to cut taxes and raise some spending and they'll argue it from a positive point of view and stand up and say, rah, rah, look what we did. right? it won't get any worse if we go into the cliff. if there's a band-aid, confusion, no clarity. the market will probably react more negatively than actually going over the cliff. i think that's what investors have to be concerned about. now, that being said, i don't think the market's going to crash by any sense, because i think there's a lot of money still on the sidelines that needs invested, bu
